Marketing outcomes depend on many factors outside our control, including market conditions, offer quality, and client participation.

3. Client Responsibilities

You agree to:

Provide accurate information

Deliver content, approvals, and feedback in a timely manner

Comply with platform policies (Meta, Google, TikTok, etc.)

Use leads ethically and legally

Delays or failures caused by lack of client cooperation are not the responsibility of Beaupapillon.

4. Payments & Refunds

Fees are outlined in your service agreement or proposal

Payments are due as agreed and are non-refundable unless otherwise stated in writing

Failure to pay may result in suspension or termination of services

5. Intellectual Property

Unless otherwise agreed:

You retain ownership of your original content

Beaupapillon retains ownership of proprietary systems, frameworks, processes, and methodologies

You may not resell, duplicate, or distribute our proprietary materials without written permission.

6. Confidentiality

Both parties agree to keep confidential any non-public information shared during the course of the engagement.

7. Limitation of Liability

To the fullest extent permitted by law, Beaupapillon shall not be liable for:

Indirect, incidental, or consequential damages

Loss of profits, revenue, or data

Platform bans, ad account issues, or third-party service disruptions

Our total liability shall not exceed the amount paid to us in the three (3) months preceding the claim.

8. Termination

Either party may terminate services according to the terms outlined in the service agreement. Upon termination:

Outstanding payments remain due

Access to services and systems may be revoked

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States of America, without regard to conflict of law principles.

10. How We Use And Share Your Information

Text Messaging / SMS Communications

We do not share your mobile information or SMS/text messaging consent/opt-in data with any third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except for aggregators and providers of the Text Messaging services who assist us in delivering the messages.
